This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your Personal Data when You use the Service and tells You about Your privacy rights and how the law protects You.


We use Your Personal data to provide and improve the Service. By using the Service, You agree to let Us collect and use Your Personal Data in accordance with this Privacy Policy. If you do not agree, please do not use our Services.

1. Notice of Collection of Personal Data

We collect the categories of Personal Data identified below. As indicated in the chart, some of these categories we “sell” or “share” (as such terms are defined in California law) for marketing purposes to business partners and third parties, such as data analytics providers, advertising technology vendors, and social media platforms as described in this Privacy Policy. We do not knowingly sell or share personal information about persons under the age of 16. Please click the link in the page footer, entitled "Your privacy choices" to opt out of the sale or sharing of your Personal Data, including targeted advertising. You may also choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”).  We will process the GPC signal as a request to opt out.

B. The Business and Commercial Purposes for Which We Collect and Use Your Data:

The Company may use Your Personal Data for the following business purposes:

  • To provide and maintain Our Service, including to monitor Your usage of Our Service.
  • To manage Your Account when you register to use the Service. Creating an account allows You to Access certain features of the Service.
  • To perform a contract You have with Us, so We can provide You with or receive the goods and/or services you have purchased from or are providing to the Company.
  • To contact You with updates related to the Service by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications, when necessary or reasonable for their implementation.
  • To manage Your requests, such as Customer Service requests or questions about our Service.

The Company may use Your Personal Data for the following commercial purposes:

  • To provide You with offers, advertisements, and other content that may interest You about other goods, services and events that We offer that are similar to those You have already purchased or inquired about unless You have opted not to receive such information. You may have the option to opt out of some of these uses, as described in the “Your Privacy Choices and Rights” section below.

C. Retention

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will also retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we must retain your Personal Data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analytic purposes and to improve the Service, such as improving security. We may also retain Usage Data as required for legal purposes.

2. Definitions
For the purposes of this Privacy Policy, capitalized words have the following meanings, whether singular or plural:

  • Account means Your unique account used to access Our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Application means the Flock Freight software program accessible via website, tablet, or mobile phone.
  • Company (referred to as either “the Company,” “Flock Freight,” “We,” “Us,” or “Our” in this Agreement) refers to Flock Freight, Inc.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Personal Data is any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You, and includes “Personal Information” or similar terms as defined in applicable law.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals the Company employs to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how customers use the Service.
  • Service refers to Our website and the Application.
  • Social Media Service refers to any website or any social network website through which a user can log in or create an account to use the Service.
  • Usage Data refers to data collected automatically, either generated when You use the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable

3. Sources of Your Personal Data

We collect Personal Data from the following sources:

  • When You provide it to Us: For example, We collect Your Personal Data when you make a purchase or sign up for an account with Our Service.
  • From Your Device: We collect some Personal Data automatically from Your Device when You use the Service, such as online activity, cookies, or Your IP address.
  • From Third Parties: We collect some Personal Data from third-party integrations, websites, arid other third-party sources.

4. How We Disclose Your Personal Data

A. We may disclose each category of your Personal Data that we collect in the following situations:

  • With Service Providers: We may share Your Personal Data with Service Providers to monitor and analyze how consumers use our Service and to contact You.
  • For business transfers: We may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company. We will endeavor to ensure that the company that receives Your Personal Data will maintain similar protections as those indicated in this Privacy Policy.
  • With Affiliates: We may share Your Personal Data with Our Affiliates, in which case we will require those affiliates to honor this Privacy Policy.
  • With analytics providers: We also share your Personal Data with analytics providers to learn more about how You use the Service, to improve Our Service, such as monitoring security and Service downtime, and to build better relationships with Our customers.
  • With marketing and advertising partners: We disclose your Personal Data to third parties for marketing and advertising purposes, including social media platforms, third-party advertising networks, and other parties that assist us in serving and optimizing our advertisements.

Certain disclosures may be considered “sales” or “shares” of Personal Information under applicable U.S. state privacy laws. Details on how to exercise your legal rights with respect to such “sales” or “shares” can be found in the “Your Privacy Choices and Rights” section below.  

B. We may also disclose each category of Your Personal Data that we collect under the following circumstances:

Law Enforcement
Under certain circumstances, We may need to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

Other Legal Requirements
The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the Company’s rights or property
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Service customers or the public
  • Protect against legal liability

C. Sharing of information by you:

When You share Personal Data or otherwise interact in public areas of the Service with other users, those users may view the Personal Data You share. This includes user-generated content You disclose on our Services, including comments or reviews about products. Please exercise caution when disclosing such Personal Data in these public areas.

5. Transferring Your Personal Data

In the course of providing the Services, We may transfer Your Personal Data outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction. If you submit Personal Data while using the Service, You agree to such transfers.

6. Personal Data Security
The security of Your Personal Data is important to Us, but no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.


7. Your Privacy Choices and Rights
You have some choices about how We collect or use your Personal Data.

  • A. Emails. You can unsubscribe from, or change Your preferences for, our marketing emails. To do so, click the unsubscribe link at the bottom of our marketing emails. Even if you unsubscribe, We may still send you some informational emails. For example, we will send you emails about Your orders or updates We make to our Privacy Policy or Terms of Use.
  • B. Account Information. If You have an account with Our Services, you can review and change the identifiers You provided to create Your account.
  • C. Cookie Opt-Outs. When You use our Services, We sometimes place cookies on Your browser that allow Us to show You advertising when You’re visiting other sites. You can click the link in the page footer, entitled "Your privacy choices" to stop Flock Freight from placing those cookies.

E. Privacy Rights and Requests

Depending on your U.S. state of residence, you may have certain rights in relation to your Personal Information, including:

  • Right to Know: You may have the right to know what Personal Information we have collected about you, including the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we have collected about you. Please note that we may not be required to respond to your requests “to know” or access specific pieces of Personal Information more than twice in any 12-month period.
  • Right to Data Portability: You may have the right to access your information in a portable format.
  • Right to Delete: You may have the right to request that we delete Personal Information that we have collected from you, subject to certain exceptions.
  • Right to Correct: You may have the right to correct inaccurate Personal Information that we may maintain about you, subject to appropriate verification.
  • Right to Opt Out of Certain Types of Personal Information Uses and Disclosures:  We use and disclose to third parties Personal Information for analytics and advertising purposes. Accordingly, you may have the right to opt out of the “sale” or "sharing” of your Personal Information, or the use and disclosure of your Personal Information for “targeted advertising” (as these terms are defined in applicable law).

Please note that, where permitted under applicable law, we may decline a request if we are unable to verify your identity (or an agent’s authority to make the request) and confirm the Personal Information we maintain relates to you.

You must put the statement “Your Privacy Rights” in the subject field of your email. We may take steps to verify your identity before responding to your request by asking you a series of questions about your previous interactions with us. Submitting a privacy rights request does not require you to create an account with us.

We will not discriminate against you if you decide to exercise your privacy rights.

Agent Requests

Only you, or someone legally authorized to act on your behalf, may submit a request related to your Personal Information. You may also submit a request on behalf of your minor child.
Depending on your U.S. state of residence, you may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf. Company retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity.

Opt-Out Requests
You may request to opt out of the sale or share of your Personal Information, or of targeted advertising, at any time by clicking the “Your privacy choices” link in the page footer, or you can email us at dpo@flockfreight.com .

Submitting an opt-out request does not require you to create an account with us.


Alternatively, you can use certain preference signals to exercise your sale and sharing opt-out right automatically with all businesses that you interact with online, including Company. If you enable a browser-based opt-out preference signal, such as Global Privacy Control (GPC), upon receipt or detection, we will treat the signal as a valid request to opt out of the sale or sharing of personal information linked to that browser and any consumer profile we have associated with that browser. Please note that if you use different browsers or browser profiles, you will have to enable the signal on each browser or profile.

Right to Appeal

8. Children’s Privacy
Our Services are intended for a general audience. We do not direct Our Services to children under sixteen (16), nor do we knowingly solicit or collect Personal Data from anyone under the age of sixteen (16). If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of sixteen (16) without verification of parental consent, We will take steps to remove that information from Our servers.

9. Links to Other Websites
Our Service may contain links to other websites that We do not operate. If You click on a third-party link, You will be directed to that third party’s site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

10. Changes to this Privacy Policy
We reserve the right, in our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Privacy Policy at any time. . We will notify You of any changes by posting the new Privacy Policy on this page and updating the “Last Updated” date. By continuing to use the Service after We have updated the Privacy Policy, You agree to those changes. If we change the Privacy Policy in a material way, we will provide appropriate notice to you.
